Abstract

The development of family conflicts that are judicialized generate an inconvenience that is amplified in the field of judicial proceedings in the family specialty, especially since time generates a distortion of rights that denatures the concept of dignity between the parties involved in the process and in the same family conflict that in a derivative way causes that the subjects of rights participating in said judicial process do not have a condition of “material equality”, being this negative situation invisible to the judicial system.

The text has a descriptive and analytical methodology of the national judicial reality, delimiting itself to the jurisdictional scope in the family specialty.
