THE URGENCE OF AN ANTI-RACIST PEDAGOGY: IMPACTS OF THE INCORPORATION OF THE ARTICLE 4, X, FROM THE NEW INTER-AMERICAN CONVENTION AGAINST RACISM ON THE BRAZILIAN LEGAL ORDER

Abstract

This paper discusses the fight against racism and racial discrimination by the inter-american system of human rights protection. In this context, important points related to the article 4, X, of the Inter-American Convention against Racism, Racial Discrimination and Related Forms of Intolerance are addressed. It is also verified whether the incorporation of the conventional text in Brazil will provide an increase in the protection of non-white populations in helplessness situations. This study, thereby, contributes to the research agenda in the commitment to eradicate discriminatory practices by the brazilian State. Furthermore, it aims to promote legal equality through the application of the mentioned article. For this purpose, a bibliographic review on human rights and raciality and a jurisprudential analysis were used, as well as case studies. It is concluded, therefore, that the incorporation of the Convention, if interpreted from legitimate racial theoretical assumptions, especially with regard to the production of anti-racist pedagogical tools, will bring an important strengthening in the fight against racism in the country, which demands an effort, even from the agents in charge of applying the text of the treaty.
