Compatibilidade do teletrabalho com o sistema jurídico brasileiro à luz da teoria do ordenamento de Bobbio

Abstract

This article analyzes telework in Brazil and discusses the compatibility of the regulation of this type of work with the domestic legal system. To achieve its objective, the study was developed through a bibliographic review, identifying the antinomies, based on Norberto Bobbio's theory on the legal system, supported by the ideas of Hans Kelsen's normative hierarchy. Having verified the antinomies between Laws Nº. 13.467/2017 and Nº. 14.442/2022 and other Brazilian laws, the comparative method was used to seek possible corrective interpretations to address the internal normative conflict. The research suggests that workers' rights are fundamental rights and, therefore, enjoy special protection. Therefore, the legislative changes in the CLT integrate and complete the national normative system, obeying the hierarchy of norms, especially because the antinomies observed can be resolved by the interpreter's action, without necessarily eliminating the existing norms.
