Abstract

This paper aims to analyze popular participation in the decision-making process of the National Supplementary Health Agency (ANS). To this end, the bibliographic research carried out in part of the Brazilian constitutional and administrative doctrine is adopted as methodology, as well as the documentary research of data prepared by IPEA and reports extracted from the ANS website. It starts from the hypothesis that there is a deficit of democratic legitimacy with regard to the participation of society in the decision making of such an autarchy. It was anchored in authors who approach the subject from a critical perspective, highlighting the problems of considering participatory media as formal tools. Thus, we conclude by pointing out the paradox of a model that is intended to be participatory, but which, in fact, ends up being taken over by health plan operators.
