Abstract

This article addresses the possibility of stipulating rules designed to condition the actions of gatekeepers within the Brazilian digital market. For a better understanding of the subject, the discussion is divided into three parts. The first deals with the gatekeeper’s concept and the impacts of its actions on free competition. The second presents the main regulatory initiatives that exist around the world. The third takes care of the legal treatment currently given to these undertakings, within the national reality. It is concluded that small legal adjustments are needed to encourage the better functioning of this sector. However, it is important that the imposed regulation do not become a distortion of its own, affecting the balance of the market.
